What do I do about a legal summons?

I am a student and I was served with a legal summons from a credit card co Capital one through one of their lawyers in Portland, oregon and there giving me thirty days to come up with an answer. that I haven’t paid on and now they want to sue me. The papers say its breach of contract and money And I work at a very low income job, I barily make it from payday to payday and I sure don’t have the money for a lawyer or filing fee. Any help would be appreciated. Any legal suggestions of what to do

If it is a summons, the credit card company already has sued you. That’s what the summons is. Attached to it would be a document called a “complaint.” It will have numbered paragraphs that state the name of the credit card company, your name and where you live, and what the plaintiff accuses you of doing.

An answer is a a document responding to the complaint. It must be served by the deadline on the summons or — the folks here are correct — the company can get a “default judgment” against you, which means you lose automatically without the chance to defend yourself.

Go speak with a dean or someone whose job it is to help students. Your school may be able to help you out.

A default judgment could lead to the court permitting the credit card company to garnish your already low wages.
